The Enhancement Project of Workforce Management and Working Environment for the Cleaning Team

The Project aims to perform research and analysis of the labor conditions of the cleaning team in Taiwan by collecting information concerning laws and regulations, management, occupational safety and labor rights. The methodology includes document analysis, questionnaire survey and in-depth interview. After doing researching on the process of the cleaning teams’ establishment and cleaners’ employment, the Project makes comparison between the types of workforce in different government agencies. By clarifying the legal relationship between cleaners and the enforcement agency as well as the critical issues, the Project aims to develop the supporting measures regarding the employment and management of the cleaning team. According to the study and analysis, the personnel management of the cleaning team is a matter of local self-governance, and its labor conditions are determined by each enforcement agency. It is a private law labor contract and there is no unified regulation by the central government. Considering the selection and employment of the public service providers along with the issues that may arise, the Project puts forward four proposals concerning the management of the cleaning team: Plan A: The central government shall formulate consistent regulations for the enforcement agencies to comply with, and each enforcement agency maintains the existing employment system. Plan B: The central government shall formulate consistent regulations for the enforcement agencies to comply with, and cooperates with the needs of the enforcement agencies to discuss organizational transformation practices. Plan C: Use the means of private law autonomy to form labor relations in the personnel system, and each enforcement agency maintains the existing employment system, but does not involve organizational adjustment issues. Plan D: Use the means of private law autonomy to form labor relations in the personnel system, but it is still necessary to study and discuss strategies to promote organizational transformation based on the needs of the enforcement agency. In addition to discussing the feasibility assessment of each plan and its corresponding supporting practices, by holding three symposiums with experts and scholars, the Project collects information and suggestion to perform analysis. Afterwards, by holding eight symposiums involving the stakeholders, the Project collects suggestions on the supporting measures for its proposals concerning the management of the cleaning team. Further modifications and feasibility studies are also completed. Besides, the Project also holds three occupational safety seminars to discuss how the central environmental protection authority should position the functions of the cleaning team's occupational safety mechanism as the employer of the cleaning team is the enforcement agency. After comprehensive discussions, it is suggested to continue to follow up in the form of a task force as a suggestion for future improvement of each enforcement agency.
