噪音陳情案件研析鑑定、處理輔導計畫

中文摘要 噪音陳情案件為主要公害陳情項目之一,民國 97年計 5萬 2千餘件;98年增加至6萬768件。為解決民眾困擾,本計畫主要目標包括:彙整及分析噪音陳情案件、辦理噪音陳情案件輔導改善工作、協助環保署進行近鄰噪音改善之宣導工作、辦理噪音監測、陳情案件處理溝通技巧說明會及全國噪音管制工作檢討會等。 所完成工作內容包括:(1)針對最近3年噪音陳情案件及重複陳情案件依陳情型態、處理過程、處理結果彙整及分析,並針對各縣市陳情類別特性進行調查訪談及研析。且蒐集實施1999陳情專線之縣市其陳情案件處理流程,分析其噪音陳情案件數量之變化情形,提出因應建議。(2)輔導100件噪音陳情案件,並針對其中20件進行後續追蹤作業,輔導對象最多者為娛樂營業場所,共計67件;噪音源設施多以冷卻水塔及擴音設施為主。針對過去1年間曾輔導之噪音陳情輔導案件進行追蹤調查共10件。(3)整理分析近鄰噪音主要種類、改善方法及處理程序。(4)更新『噪音陳情宣導手冊』、『吸音隔音材料簡介手冊』及『噪音改善案例參考手冊』,並增加相關輔導改善案例,再彙編成『圖解噪音手冊』。(5)蒐集相關噪音案件法院判例,並分類置放於網頁供民眾查閱。(6)辦理 1場次「手冊專家審視諮詢會議」、5場次「噪音監測及陳情案件處理溝通技巧說明會」、以及協助環保署辦理 1場次「全國噪音管制工作檢討會」,今年擴大舉辦成「2010年華人地區噪音管制策略研討會」。

The project of analysis, examination and treatment of noise complaint cases

英文摘要 The noise complaint was one of the major public environmental pollution, the number of noise complaints were approximately 52,000 cases in 2008. In 2009, the number went up to 60,768. In order to solve this problem, the objective of this project was including compiling and analysis of noise complaint cases, executing of counseling for noise complaint cases, assisting EPA to promote neighbor noise improvement, and holding noise measuring and complaint cases handling meeting and noise control affairs conference. The abstract of all tasks are as follow. 1. Compiled and analyzed of the complaint cases and repeated-pleading cases in the last 3 years by types, processes, and results. Invested the characteristics of the complaint cases in different cities. Moreover, collected the changes in the number of complaint cases through “1999” hotline phone number. 2. Completed 100 cases of counseled noise complaints, and continually tracking 20 cases among these cases. The complaint cases for business places and entertainment establishments were main complaint cases, which were accounting for 67 cases. In addition, cooling tower and broadcast facilities as the main noise source of counseled cases. This project was completed tracing of 10 counseled cases in the past year. 3. Compiled and analyzed the types, improvement methods and processes of “Neighbor Noise”. 4. Updated the “Noise complaint guide book”, “Sound insulation and absorption materials guide book”, Noise improvement method and cases study guide book” and added related counseling for noise complaint cases into a “Graphical noise guide Book”. 5. Collected related court cases of noise complaint to website for public to browse. 6. Held one specialist counseling meeting of noise guidebooks, five meeting of noise measurement and complaint handling conference, and one conference of "2010 Chinese Area Noise Control Strategy Conference ".
