「地質法施行後涉及環境影響評估審查作業執行」專案工作計畫

中文摘要 本計畫透過地質法分析、相關法規資料蒐集、地質敏感區公告現況及其他方式彙整分析了解地質法與相關法令之競合關係，以此為基礎建立基地地質調查及地質安全評估審查機制，同時召開專家、學者及相關主管機關代表座談會，調整並落實基地地質調查及地質安全評估審查機制。綜上，透過本計畫執行本案，於地質法及相關環境影響法規中，建立有所依循之審查機制，可利環保署於地質法施行後涉及環境影響評估審查作業執行業務之推動，其彙整結果如下：本計畫已完成地質法及相關環境影響法規之資料蒐集，3場次審查機制座談會，並完成基地地質調查及地質安全評估審查機制建立，完成65次環境影響評估審查作業。最後本計畫建議後續執行單位可參考本審查機制進行審查，並依據地質法相關規定及作業準則及環保署「開發行為環境影響評估作業準則」中有關地質項目之第5條、第19條及附表8環境影響預測及評估方式，進行環境影響評估實質審查。

Review Operations of Environmental Impact Assessment after Geology Act comes into force

英文摘要 In order to establish a base of geological surveys and geological safety assessment review mechanism, this project collect and integration analysis relevant laws of Geology Act, geologically sensitive area to figure out the relationship between Environmental Impact Assessment act and Geology Act. This project also organized 3 expert workshops and formulated responses to public suggestions regarding modifications to the review operations of environmental impact assessment. The main accomplishments of the present study are as follows: (1) Organized 3 expert workshops and formulated responses to public suggestions regarding modifications to the review operations of environmental impact assessment. (2) Establish review operation mechanism of environmental impact assessment. (3) Finish 65 review assistances of geological surveys and geological safety assessment. The results will aid the planning of future directions of review operations of environmental impact assessment; recommend necessary modifications to the EIA laws and related Geology Act, and help coordinate resources of all relevant ministries and local governments in order to establish their own review operations.
