With an increase in urban population density and industrialization, the occurrence of a variety of environmental nuisances has become increasingly prevalent. These environmental nuisances include but are not limited to noise pollution (including low frequency noise), water pollution, and air pollution and equivocally have made a serious impact on the quality of life of the public. The problem therein lies in when the general public encounters these environmental nuisances but are not well informed of their legal rights or do not possess any knowledge relating to public nuisances. The various impacts produced by environmental nuisances are all separately different and unique, which as well possess public, private, and fluctuating characteristics, among others. Worse yet, victims of environmental nuisances may not have the financial ability to afford the procedural burdens generated from the advocating of their legal rights; therefore, in consideration of the protection of people’s rights and the convenience for the public to utilize their legal rights, the Environmental Protection Administration(“EPA”) suggests that during the development of a legal project, such project shall include the following:
1. Preliminary project work related to legal services for public nuisance disputes and the results of implementing consultation.
2. Acquisition of legal representation provided from the Legal Aid Foundation (“LAF”) for public nuisance disputes and the results of implementation.
3. Continued development of the existing domestic LAF system and the research/analysis of amending related laws.
1) Amendment of important notices/explanations of LAF projects related to public nuisance disputes.
2) Research legal issues/regulations related to environmental liabilities.
4. Research issues related to offset schemes for environmental funds.
5. Plans for environmental protection educational training courses.
