103年度污染場址環境責任認定與風險移轉機制及信用保證基金制度建置計畫
| 中文摘要 | 本計畫以污染場址相關之環境責任保險制度設計以及信用保證貸款制度規劃為目標，透過對於國外經驗與制度的解析並配合國內現行機制的分析，完成制度推動建議方案。搭配相關制度的推動需要，建立專屬於土壤與地下水污染整治的相關保險規範設計以及保單條款範本，以為後續推動實務上的重要工具，且該範本充分定義相關的承保範圍，將可用於退費機制審查之依據。針對信用保證基金制度，本計畫完成相關之規範設以及實施要點內容初擬，就實務上而言具有一定的可行程度，惟土污法的法源與授權應該是整體信用貸款制度中較具挑戰性的門檻。此外，對於信用保證基金制度的長期規劃，應該考量結合污染土地再利用政策，以建立其獲利模式，方能維持基金之永續運作。 | ||

| 英文摘要 | The objectives of this study include designing the environmental liability insurance policy for contaminated site and a credit guarantee fund for facilitating small to mid-size companies to engage necessary remediation actions. Through investigating the progress and policy of different countries, this study has proposed a potentially feasible environmental liability insurance policy framework with necessary protocols. The protocols include insurance clauses, application form, and related templates. They will be vital for future implementation of the environmental liability insurance as well as the refund mechanism of the remediation fund collection. A credit guarantee fund mechanism is also proposed based on the local existing systems and foreigner countries experience. The major obstacles for the credit guarantee fund are the targeted applicants and the pay-back capability of the applicants. It might be resolved in a shorter term by limiting the qualification of the applicants. However, it is suggested to link with the domestic brownfield program to create a beneficial way of return and a sustainable way of operation. | ||
