廢棄物個通案認定、連帶責任及裁罰準則等法令檢討研析計畫
| 中文摘要 | 本計畫主要協助研提廢棄物清理法第63條之1增訂子法之初擬建議、蒐集「事業委託清理之相當注意義務認定準則」實施情形及研析廢棄物管理技術面及制度面之精進方向。本計畫蒐集國內外文獻與行政法院判決及參考5場次公聽研商會各界所提意見，協助研提廢棄物清理法第63條之1增訂子法初步建議內容。本計畫透過訪談業者及召開輔導說明會，蒐集「事業委託清理之相當注意義務認定準則」施行後各界意見，研析法令適用疑義及精進建議。經研析美、日之煤灰管理規範，建議煤灰之再利用應加強流向管理、再利用前評估及後續環境監測等管理方向，避免再利用後污染環境風險。另研析美、日及歐盟之廢棄物溶出試驗，建議維持現行TCLP檢測方法，並針對不同環境中廢棄物再利用方式以不同檢測方法進行檢測。本計畫彙整中國、德國及日本發展循環經濟概況，提出資源物質是否適用廢棄物清理法及廢棄物通案認定程序之研析建議。此外，蒐集連帶賠償責任、求償時效、不法利得沒收及擴大沒收相關法令，並參考3場次跨部會研商會議意見，協助研提司改國是會議有關廢棄物管理之法制意見。計畫執行期間協助辦理3場次法規宣導座談會、4場次專家諮詢會，並提出17則法律意見書。 | ||

Project on reviewing and analyzing regulations regarding the industrial and general case identification of wastes, joint liability, and penalties
| 英文摘要 | The purpose of the project is to assist in the review and analysis of Article 63-1 of the Waste Disposal Act Sub-Law, collect implementation of the Regulations Governing Determination of Reasonable Due Care Obligations of Enterprises Commissioning Waste Clearance, and analyze potential improvement of waste management technology and system. This project collects related literature and administrative court decisions, referring to 5 public hearings with comments from various sectors, to facilitate the review and analysis of Article 63-1 of the Waste Disposal Act Sub-Law. Through interviews and counseling sessions, the project aims to analyze the implementation of the “Regulations Governing Determination of Reasonable Due Care Obligations of Enterprises Commissioning Waste Clearance” and its recommendations Drawing from the review and analysis of coal ash management regulations in the United States and Japan, it is recommended that the flow management of the reuse of coal ash, its pre-reuse evaluation and follow-up environmental monitoring should be strengthened to minimize environmental pollution risks. On the other hand, it is recommended to maintain the current TCLP testing method after reviewing and analyzing waste leaching tests in the US, Japan and the European Union. This project compiles the development of circular economy in China, Germany and Japan, and proposes research and analysis recommendations on whether resource materials should be subjected to provisions of the Waste Disposal Act and the standardized identification procedures for waste. The project compiles laws and regulations on joint and several liability, time limit for claims, confiscation of unlawful gains, and extended confiscation, referring to the opinions from three inter-departmental meetings, to assist in offering legal advice to the Justice Reform Committee regarding waste management. During the course of the project, a total of 3 seminars on promoting regulations and 4 expert consultation meetings were held, and 17 legal opinions were issued. | ||
