固定污染源許可證及定檢制度管理暨整體控制策略檢討計畫

中文摘要 本計畫依據109 年度與110 年度規劃二階段許可管理制度檢討期程,除彙 整蒐集許可證管理辦法執行遭遇問題外,同時針對固定污染源各項橫向管理制 度進行彙整、研析並檢視許可管理制度與其關聯性,例如接軌定期檢測管理制 度檢討與修正,強化檢測代表性、提升檢測結果應用品質,研議有害空氣污染 物導入許可管理制度方式、許可管理對象新增與修正,同時檢視各縣市許可制 度執行之許可證審查人員和技師簽證之管理與許可證核發品質查核,研擬防制 設備設置與操作管理作業,並更新擴充固定污染源管理資訊系統功能與資料庫 品質檢核,且依據今(111)年度計畫目標訂定固定污染源許可管理、定期檢 測管制、防制設備設置與操作管制、許可制度推動與人員管理及系統配套工具 等五大面項,其各項工作成果摘要說明如后。 本計畫藉由分析各許可證審核機關固定污染源許可證審核情形,發現部分 縣市許可證審查天數超過法定審查日數,且對於整體審查符合規定比例仍有 30%未符合,因此,本計畫依據109 與110 年度許可管理辦法修正後執行遭遇 問題,研擬擴大第三類對象簡政便民、導入減量誘因及橫向接軌固定污染源管 制修正之必要,檢討修正許可證管理辦法;此外,本計畫有鑑於美國聯邦與南 加州建立之許可分級管理制度已行之有年,並已將有害空氣污染物與其健康風 險評估納入許可證管理,遂彙整比較國內外有關許可證採排放量分級管理、有 害空氣污染物與風險評估導入許可證管理期程,規劃全廠、製程及核備等許可 管理方式。 本計畫另依據今(111)年度修正檢討重點與調整內容,著手修正許可證 審查指引修正、許可證申請文件新增代申請人員資訊及有關空氣污染防制專責 人員訓練教材。 而在公告條件部分,為因應許可管理辦法新增之第三類固定污染源,本計 畫分析我國1 到8 批管制現況,發現我國管制之粒狀污染物、SOx、NOx 及 VOCs 年排放量皆小於1 公噸之非毒性物質運作製程約有1,782 張許可證,而 新增納管對象大多位於桃園市、臺中市、彰化縣;臺南市與高雄市等縣市,可 藉由設置操作並申請、簡化技師簽證與試車檢測替代等簡化程序來提升審查效率;在揮發性有機物許可證管理部分,現行有機溶劑作業程序以使用全量管 理,為使排放量計算與許可證管理門檻計量方式一致並避免有抓小放大之疑 慮,新增第九批有機溶劑年用量達5 公噸者應申請許可證,且排除有機溶劑含 量10%以下之對象,預計新增納管261 個製程;而全廠鍋爐管制方面,針對全 廠不分燃料類別之鍋爐總蒸氣蒸發量合計達4 公噸/小時以上者,並排除全廠均 使用天然氣之總蒸氣蒸發量小於20 公噸/小時之對象。 108 年度修訂公告之許可管理辦法,已限縮檢測物種及驗證排放標準之目 的,使試車檢測物種繁多問題之情形已減緩,可減少約40%之檢測筆數,今 (111)年度接續檢討定期檢測管理辦法,本次修法延伸檢測管理制度,擬訂 兩層次之檢測管制規定,第一層維持現行公私場所自主管理制度,提供自主管 理較佳之公私場所頻率調整規範,以降低檢測負荷,同時連結許可證申請之空 氣污染排放檢測計畫書並賦予公私場所專責人員於檢測時應執行監督檢測等 規定,提升檢測代表性並兼具試車條件再現性,第二層則新增主管機關功能性 評鑑制度,以抽驗並協調公私場所時間以指定時間及條件進行功能性評鑑,除 用以驗證公私場所平時自主維護之情形外,亦可解決現行主管機關於執行稽查 之問題,同時規劃檢測系統建置架構與檢測警示超標功能。 另配合檢測制度修正一併檢討第一、二批定檢公告條件,並整合依空污法 第22 條授權公告應定期檢測之對象及檢測期間規定,使得定期檢測管理辦法 及應執行定期檢測對象等規範於111 年6 月6 日修正發布,並辦理教育訓練會 議。 防制設備設置與管理規劃方面,本計畫統計現行固定污染源空氣污染物收 集設施與防制設備設置情形,全國列管約2 萬家公私場所中,許可納管約8 千 家公私場所約1 萬2 千張有效許可證,掌握防制設備設置約4 萬座左右且廢氣 收集方式仍有33%為逸散,並盤點須強化集氣設施設置之製程對象外,同時針 對未設置防制設備製程污染源進行評析,最後整合已設置防制設備之固定污染 源,規劃基礎防制設備管理辦法,研擬一致性防制設備應具備之操作條件、儀 表設置及相關維護保養與參數紀錄等方式與規範。 為使各項固定污染源管制規範落實推動,本計畫持續統計固定污染源許可 管理制度中有關審查人員流動與資歷,並於許可證申請系統上新增代理申請人 員資訊填報與應公開等功能;本計畫同時蒐集各項許可證審查與核發案例、許可證管理辦法遭遇問題及相關研議重點與規畫,集中於教育訓練與管理評鑑, 辦理3 場次教育訓練會會議;而在地方主管機關績效考評強化管理制度與管制 規範落實上,今(111)年度地方主管機關與受委託機關許可證現場查核及技 師簽證查核作業共執行150 件次,另掌握公私場所由臨時工廠登記或未登記工 廠轉為特定工廠登記之許可證申請與核發情形。 固定污染源管理資訊系統含括許可證申請與審核、定期檢測申報及清查列 管資訊等許可管制大數據資料庫的更新與運轉,而為強化固定污染源資訊管 理,今(111)年度已配合許可整合完成環境保護許可管理資訊系統介接、擴 充記錄設置健康風險評估人員的工廠、增加提示可調整檢測頻率、可執行功能 性定檢的對象,提供掌握未線上通知檢測的原因,增加許可試車檢測申報資料 複製等功能,此外,配合財政部擴增統一編號號碼作業要求,先行修正統一編 號之檢查邏輯;另在資料品質提升工作項目,共計列管18,890 家工廠,超過7 千多家許可納管公私場所,為維護系統及資料品質,本年度持續執行資料檢核 作業,至9 月底已執行9 次檢核,資料平均符合比率為92.8%。

The Management and Strategy Application Project of Permit and Regular Sampling for Stationary Pollution Sources

英文摘要 Base on the two-staged revise the stationary pollution sources permit management in 2020 and 2021, we comprehended and evaluated county (city) permit reviewing agencies, public and private premises’ implement suggestions and encounter problems. Meanwhile, we summarized horizontal connection of various regulation of stationary pollution sources, such as being in line with the revision of management regulation of periodic inspection and strengthen the quality, evaluating of hazardous air pollutant integrated with stationary sources pollution permit system, air pollutant collection facilities and control facilities management, the management of permit applicants and reviewing personnel, check of technician visa, and updated the expand functions of stationary pollution sources management information system and database quality inspection. According to our goals, the project was divide into 5 major parts, including 1) stationary pollution sources permit management, 2) periodic inspection control, 3)air pollutant control facilities management, 4)permit regulation personnel, 5) system supporting tools. The following work respectively according to the content of the project descriptions are as follows: We analyzed the stationary pollution sources permit application and issuance of each reviewing agencies, some counties or cities exceeded the legal review days, and about 30% of the overall review case did not qualified. Therefore, the planning of expansion of the third-category of permit management for simplified administration, introduction of reduction incentives and horizontal connection of permit regulation amendment was necessary since amended in 2019; In addition, due to the U.S. federal government and Southern California have established classification of permit management, and incorporated hazardous air pollutant management and risk assessment for many years. As a consequence, we have compiled and compared domestic and foreign related permit management system and planned the methods of the whole plant, process and verification. Also, based on the revision of permit management regulations of stationary sources pollution this year (2022), we revised the revise guidelines for permit reviewing, the permit application documents, and the course materials for dedicated air pollution control personnel to adjusted content. In the announcement conditions part, we responded to the addition of third-category stationary pollutions sources in the permit administration, we analyzed the current control state of the first to eighth permit batches. The results revealed that there were about 1,782 permits’ operations using non-toxic substances with annual emission of particles, SOx, NOx and VOC all less than 1 metric ton. The added third-category permits are mainly located in Taoyuan City, Taichung City, Changhua County, Tainan City and Kaohsiung City. To increase permit reviewing efficiency, simplified procedures such as combining installation and operating permit application, simplifying the technician visa and supplying alternative plan for commissioning and inspection are available. in the permit management of volatile organic compound part, the current organic solvent operation procedures are based on the use of full amount management. In order to make the emission calculation consistent with the permit management measurement method and avoid the doubt of small and large expansion, the annual consumption of the 9 batch of organic solvents over 5 metric tons should apply for a permit, excluding organic solvent content less than 10%.261 new processes are expected to be managed. Regarding boiler management for the whole plant, after involving boilers with the total steam evaporation more than 5 metric tons/hour in the whole plant, regardless of fuel type, and eliminating natural gas boilers with the total steam evaporation less than 20 metric tons/hour in the whole plant. To revise periodic inspection regulation continuously and planned two-staged inspection management regulation, the first stage remained the current independent management system for public and private premises, and provides better self-management frequency adjustment specifications to reduce the inspection word load. Furthermore, to enhance the representativeness of testing and encourage public and private premises to maintain more autonomously, the connection between revised inspection regulation and permit air pollution emission test plan and the regulation that premises’ dedicated personnel were asked to perform supervision during inspection were set. In second stage, the new functional evaluation system is added to randomly check and coordinate the inspection time of public and private premises. Besides verifying the autonomously maintenance of premises, the system can also provide the solution for the implementation issue of audit. Meanwhile, we planned the construction of the inspection management system and with the function of warning the inspection exceeding emissions standard. Coordinating with the revised inspection regulation, the 1 and 2 batches of inspection announcement conditions were also revised and integrated with object announced with periodic inspection and regulations for the inspection period authorized by Air Pollution Act Article 22. Stationary pollution sources of periodic inspection and reporting management regulation amended and the announcement conditions of the public and private premises with stationary pollution sources shall perform periodic inspection are released on June 6th, 2022 and conducted education and training meeting. In the air pollutant control facilities management part, we statisticized the current stationary pollution sources of air pollutant collection facilities and air pollutant control facilities. In twenty thousand public and private premises, we grasped approximately eight thousand public and private premises were under permit management, approximately twelve thousand valid permits, about forty thousand sets of control facilities’ are installed, and 33% of the air pollution collect type is still dispersed into air. We inventoried the stationary sources shall be installed air pollution collection facilities and air pollution control facilities and evaluated the stationary the sources without air pollution control facilities. Finally, integrating the stationary sources that are installed air pollution control facilities, we planned the basic air pollution control facilities management regulation, developed the operation conditions of air pollution control facilities, parameter recording of instrumentation and maintenance service. To promote the implementation of various regulation of stationary pollution sources, we statisticized continuously the turnover and qualifications of reviewing personnel in the stationary pollution source permit management system, and provided the functions such as applicant personnel information and publication. Moreover, 3 education and training meeting about permit common cases, system functions and execution performance were held to enhance the professional ability and the quality of management of reviewing personnel. In the part of management and implementation of performance appraisal to local authorities, 150 cases of permit on-site verification operation and 30 cases of verification of technicians visa were performed, furthermore, the permit application and issuance of public and private premises transferred from the temporary factory registration or the unregistered factory to the specific factory registration were also grasped. Stationary pollution sources management information system included permit application and issuance, periodic inspection declaration and the update and operation of the big data database of permit control. To strengthen the information management of stationary pollution sources, this year (2022) we integrated the connection with the information system, expanded the function of being recorded the factory has established health risk assessment personnel, added prompts to adjust the detection frequency, and perform functional inspections, provided the reviewing personnel grasped the reasons for not being online-notified before the inspections, and added the record of inspection copied by permit application. Beside, Cooperate with the Ministry of Finance has expanded for the unified numbering operation requirements, revised the inspection logic of the unified numbering in advance; Furthermore, in data quality improvement part, a total of 18,890 factories were under management, and more than 7,000 public and private premises have been managed. To maintain the system and data quality, we performed 9 times of data checking operation till September, 2022. The average corresponding rate of data is 92.8%.
