我國加入世界貿易組織後涉及巴塞爾公約相關法律問題之研究
| 中文摘要 | 隨我國順利加入WTO，新的國際身分提供給我們許多重新思考或調整參與國際事務的空間，這其中尤其對於許多我國無法加入而卻必須配合履約的多邊環保協定（Multilateral Environment Agreement）的後續參與最具意義。以巴塞爾公約相關規範之本身所具有的貿易關聯性為例，就讓我國得自長期的角度來思考其相關之互動與問題。本年度之研究主題可以包括以下幾個課題： (一) 當前國際間之相關發展的掌握部分：包括WTO有關環境與貿易議題之發展及其與多邊環保協定之間的關聯性議題之研究，以及GATT/WTO架構下之爭端解決機制與巴塞爾公約架構下爭端解決機制之相容或調和問題之研究。 (二) 其發展對於過去我國因應巴塞爾策略之應有或可能調整部分：包括我國如何持續以非締約國（non-party）之身分來履約？以及在我國取得WTO會員身份後對於後續在巴塞爾公約持續採行片面遵約相關政策與作為之影響以及應有所調整之方向。 (三) 我國進一步援用WTO身分來拓展公約參與空間之機會部分：包括如何藉由WTO之發展來爭取實質參與巴塞爾公約之機會？尤其巴塞爾公約仍在發展中之技術委員會與法律規範之制定部分。此外並應包括相關大陸因素之影響與評估。 | ||

The research of related legal issues involving the Basel Convention after Taiwan joined the WTO
| 英文摘要 | As a result of Taiwan has acceded to WTO successfully, the new international status provides us opportunities to reconsider or regulate participating in international affairs. The most meaningful is the follow-up participating in MEA (Multilateral Environment Agreement) that we can’t join in but need to cooperate ones. For example about the trade connection of the related standards of the Basel Convention, we may think over the related interaction and issues by a long-term point of view. The research subject of this year including the following topics: 1. To know well the current international related developments, it includes the development of the environment and trade issues of the WTO, and the research of the WTO and MEA interface correlated issues. With respect to the harmonization and reconciliation between the dispute settlement mechanisms in the GATT/WTO framework, and those found in the Basel Convention. 2. With reference to the development of adjustment our strategy to the Basel Convention in the past: it includes that how does Taiwan continue implement the Basel Convention by non-party? And the influence of Taiwan adopts unilateral compliance policy and actions to the Basel Convention and adjusting the direction after we joined the WTO. 3. As far as Taiwan expands the opportunities to join the Basel Convention by using the WTO member status: it includes how does Taiwan win over the chances to take part in the Basel Convention substantiality by the development of the WTO? Especially in the Basel Convention Technical Working Group and legal regulations that are still setting up. And it also includes the influence and assessment of China. | ||
