環境損害賠償與補償法草案中環境責任保險條文增修專案工作計畫
| 中文摘要 | 環境保護署已研擬完成之「環境損害賠償與補償法草案」，以「強制環境責任保險」為該草案所擬建立之環境損害救濟制度之三角建構關係中不可或缺之一角，惟該草案有關強制責任保險，僅設有三條條文，本研究乃針對該草案第三章「環境責任保險」，研擬增修為二十七條條文，以資完備。 研擬增修之條文內容主要包括：強制投保之法律依據、分段實施之授權、主管機關、保險人之資格、共保及危險承擔機制、保障範圍、保障金額與不保事項、請求權之行使及其效果、投保方式與強制締約、解除或終止契約之限制、設施所有權之移轉、暫時性給付、共生之環境損害事故、保費結構、費率釐定與保單擬定之授權、獨立會計與準備金之提存等。 此外，本研究亦對於歐洲及美國環境責任保險之發展經過加以介紹分析，做為我國將來實施之參考。 | ||

Task Force on the Draft of Environmental Impairment Damages and Indemnity Act regarding Environmental Liability Insurance
| 英文摘要 | The EPA has recently finished the Draft of Environmental Impairment Damages and Indemnity Act. This Act is to build a tri-angle construction for the environmental impairment recovery system and the compulsory environmental liability insurance is one of them. However, there are only three sections set forth in the chapter of Environmental Liability Insurance in the Act. To provide an entirely detailed chapter, this project submits 27 sections concerning the environmental liability insurance. The 27 sections concerning the environmental liability insurance. include the legal basis for compulsory liability insurance, the authorization for step-by-step enforcement of the compulsory environmental liability insurance, the authoritative unit in charge of the compulsory environmental liability insurance, the qualification of the insurance companies, insurance pool and mechanism of risk transfer, coverage, insurance amount and exclusions of the insurance, the claims making and their effects, the methods of applying for insurance and mandatory agreement of contracts, the limitation of voiding and canceling contracts, the transfer of establishments and equipments, temporary payments, coincident environmental impairment events, construction of insurance premium, authorization of drafting premium rates and policy provisions, independent accounting system and reserves rules, etc. IN addition, this project also introduces and analyzes the development of environmental liability insurance systems in Europe and the United States for the reference of enforcing them in Taiwan. | ||
