土壤污染管制標準研修計畫

中文摘要 本計畫主要工作項目包括:彙整分析現行管制標準實施成效與問題、蒐集先進國家土壤污染管制相關資料、研擬土地分區管理及各級管制標準之草案內容、評估草案施行之後續影響…等,相關成果說明如下。 我國土污法施行至今共計列管2,296處(約1,189公頃)污染場址,其中部份場址經整治改善後已解除列管,目前持續列管場址則有657處(約789公頃);各界對於管制標準之主要疑慮包括:現行管制架構(除農地外)不分地區採單一標準、全量與溶出濃度考量差異、是否依據健康風險評估觀念、管制項目與限值之適宜性…等。 草案研修部分,本計畫一方面彙整美、加、英、荷、澳、日…等20個先進國家之土壤污染法規架構、管制特色及行政措施,並與國內進行相互之比較與分析;另一方面則參考國內本土研究文獻,考量現階段管制問題及辦理六場次座談會時各界所提意見後,綜合評析而訂出。 本草案主要劃分為敏感地區、一般地區及特定工業區來分別管制,項目及限值部份則以現行標準為原則,考量污染物毒性、環境流布情形、暴露風險及國內外管制建議值…等因素而訂定。最後,本計畫針對草案內容評估其後續推動上對於行政管理、經濟成本之衝擊與影響,並且研擬相關之行政配套措施。

The research of amending of soil pollution control standards

英文摘要 The major assignments of this project were to collect and analyze the effects and potential problems of the current Soil Pollution Control Standards, compile the regulation strategies of soil pollution in developed countries, research and amend the protocol of zoning management and classification of control standards, and estimate the following influences after executing the protocol. Since “Soil and Groundwater Pollution Remediation Act” was promulgated, there had been totally 2,296 pollution sites listed nationwide (about 1,189 ha.), some of them have been delisted after improvement and remediation, and presently there are 657 pollution sites listed nationwide (about 789 ha.). All circles have doubted the current Soil Pollution Control Standards as follows: the soil pollution control without adopting zoning standards (except for agricultural land), the different considerations between total concentration and extracted concentration (bioavailability) of a pollutant, the health risk assessment program for amending standards, the suitability of the controlled items and values, etc. In the process of revising protocol, this project compiled the legal framework, regulation strategies and control measures of soil pollution from 20 developed countries, such as United States of America, Canada, England, the Netherlands, Australia, Japan, etc. Furthermore, this project reviewed the indigenous research literature, considered the problems of present control methods, and collected the comments from various circles during 6 symposiums. In the contents of this protocol, the proposed Soil Pollution Control Standards established the regulation respectively for three categories of land use including “Sensitive Area,” “General Area” and “Specific Industrial Area”. In principle, the controlled items and values were consulted with the current Soil Pollution Control Standards, but further considered the toxicity, environmental fate and distribution, exposure risks and recommended values of soil pollutants. In the final section, this project estimated the following influences of administration management and economic cost in execution of the protocol, and drew up the adaptive strategies accordingly.
