廢棄物越境轉移國際因應及國內管理計畫

中文摘要 (一)實質參與巴塞爾公約及亞太區域電子廢棄物議題 1.完成巴塞爾公約夥伴計畫之執行追蹤及2007年之我國參與。 2.完成亞太區域電子廢棄物計畫及兩次NIES Workshop on E-Waste(2006.11, 2007.11)進度追蹤。 (二)輸出入管制建議 1.完成我國廢棄物越境轉移管理法規彙整:依據申請機構、申請程序、申請原則、審查程序、審查原則、檢具書件、不得核發許可要件、得廢止輸出入許可要件、運送要求、期限等議題進行整理。 2.完成巴塞爾公約、OECD及歐盟廢棄物越境轉移法規彙整及分析。 3.完成2006年度廢棄物輸出種類共42項彙整各該項廢棄物產生量、列管事業申報廢棄物處理量、非列管事業申報廢棄物處理量、處理機構(含自行處理、清理機構及再利用機構)家數及許可量、廢棄物接受國及輸出量的統計。 4.完成國內外輸出入運作流程及廢棄物清單二部分比較。 5.參酌國外輸出入法規內容,完成廢棄資源物管理法研商公聽會版本(2006年)之輸出入條文修正建議。 6.完成現行廢清法授權範圍相關解釋函彙整,並針對「境外處理業者能力資格之認定」、「財務保證」、「國際文書認證」及「禁止輸入之事業廢棄物及一般廢棄物種類」提出建議。 (三)雙邊協定推動執行 1.完成巴塞爾公約簽雙邊、多邊與區域協定彙整。 2.完成日本及我國廢棄物輸出入相關法規、流程進行介紹,並分析雙邊協定簽署後之差異、法規執行問題及運作調整建議。 3.完成加拿大與美國、美國與菲律賓之雙邊協定條文,並提出雙邊協定簽署之重點事項,同時提出可能洽商簽署雙邊協定國家之基本資料說明,以供主管機關參考。 (四)廢棄物輸出入案例彙整及研析 1.完成蒐集國外二手商品輸出入管制規定介紹,並完成輸出入貨品疑似廢棄物認定及處理作業要點(草案)及海關案例彙整。 2.完成象牙海岸有害廢棄物非法棄置案例研析,其部分處理經驗,可供我國後續參考之用。 (五)巴塞爾公約國內因應執行 1.完成辦理三次專家小組會議,議題包括:國外(歐盟及OECD)廢棄物越境轉移管理規範、廢棄物判定原則及海關案例、第2屆固體廢棄物管理與技術研討會出國報告、OEWG6與會說明及後續規劃、廢棄物輸出入管制判定參考手冊修正說明、廢棄物輸出入管理網站改版規劃、亞洲太平洋島嶼固體廢棄物專家會議及NIES電子廢棄物會議出國報告。 2.完成協助廢棄物輸出入管理相關事宜。 (六)巴塞爾公約相關會議參與:完成四個國際會議六人次會議參與,如下(1)第2屆固廢管理與技術研討會(中國北京,7月18-19日)、(2)第6次開放式工作組會議(瑞士日內瓦,9月3-7日)、(3)第3次亞洲太平洋島嶼固體廢棄物專家會議(日本岡山,11月7-9日),及(4)第4次NIES電子廢棄物會議(日本筑波,11月21-22日)等,共計發表4篇論文。 (七)巴塞爾公約資訊宣導 1.完成150則巴塞爾公約相關新聞、論文之蒐集摘譯。 2.完成資訊網頁推動歷史更新、國內現況、國際會議動態、網站地圖等更新。 3.新增海關案例查詢網頁。 4.更新廢棄物輸出入管制參考判定資料庫,累計次數達27次。 5.完成製作廢棄物輸出入管制參考手冊電子版。

Management of Transboundary Movement of Solid Waste: under the framework of international practice and domestic waste management (2007)

英文摘要 The major achievement from this project can be classified into seven aspects as follows. 1. Participation in the discussion of E-Waste related issues at the global and regional levels The latest progresses of the Basel Convention Partnership Programme, including MPWG and PACE as well as the conclusions from E-waste related meetings in Asia-Pacific region have been continuously collected and summarized. 2. Providing legal advises on the regulations regarding the transboundary movement of waste (TBM) to The Environmental Protection Administration, including: (1) Summarizing of the application and authorization regulations on TBM in Taiwan (2) Analyzing of the regulations of Basel Convention, OECD and EU on TBM. (3) The statistics of the generated and permitted amounts for TBM of 42 exported waste items from Taiwan in 2006. (4) The comparison of TBM regulations among Taiwan, Basel Convention, OECD and EU. (5) Amending the draft articles of Waste Management Act regarding waste TBM. (6) The interpretation of TBM related declaratory statutes and suggestions for the qualifications of treatment plants aboard, financial guarantee, recognition of documents and prohibited waste items. 3. Promoting bilateral agreements, including: (1) Collecting bilateral, multilateral, or regional agreements regarding Basel Convention. (2) Interpreting the contents of bilateral agreements between Canada and the USA and the articles of bilateral agreement between Philippine and the USA as references for the government. 4. Case studies of transboundary movement of waste, including: (1) Custom examination for current waste items, draft of waste identification procedure and principles and case studies of waste identification. (2) Lessons learned from the case of hazardous waste dumping in Abidjan, Côte d’Ivoire. 5. Responding to the decisions of the Basel Convention Three meetings with Basel Convention Expert Committee were organized. In which, discussed issues include EU and OECD TBM regulations, revision of the manual for controlling of waste transboundary movements and reporting of four international conferences regarding Basel Convention. Inquiry of the regulations on transboundary movement of waste of some OECD countries was also provided. Besides, analysis on the revision of China’s regulations was also completed. 6. Participating in the Basel Convention (BC) activities. In 2007, we participated in four face-to-face conferences with four papers presented: (1) the second International Conference on Waste Management and Technology in Beijing, China, (2) the 6th Open-Ended Working Group (OEWG6) in Geneva, Switzerland, (3) the 3rd Expert Meeting on Solid Waste Management in Asia and Pacific – for networking of experts in Okayama, Japan and (4) the 4th NIES E-Waste Conference in Tsukuba, Japan. 7. Collecting and promoting BC related information. We have completed and evaluated 150 news, articles, reports and papers regarding the Basel Convention, and, updated both Chinese and English Basel Convention information websites for 27 times (http://wm.epa.gov.tw/web/index.htm). The manual for controlling transboundary movement of waste in the digital format was also revised.
