97年度「廢棄物越境轉移國際因應及國內管理計畫」

中文摘要 本工作分成國際參與及國內運作二大部分,各有三項工作說明如后: (一) 國際參與-巴塞爾公約 1. 巴塞爾公約夥伴計畫 (1) 手機夥伴計畫(MPPI):此夥伴計畫歷時六年已於第九次締約國大會正式宣告結束,雖部分技術準則草案尚需配合試驗計畫進行修改。本報告中摘要說明MPPI的成果、我國參與貢獻及受到重視之主因。 (2) 電腦設備夥伴計畫(PACE):經過八個月的籌備,PACE已於巴塞爾公約第九次締約國大會宣佈成立。本報告完成PACE籌組過程的三項關鍵議題分析、摘要各次會議重點、我國參與貢獻並提出未來參與之最佳方式,以利後續執行。 2. 完成第九次締約國會議(2008.06)三人次之與會,並提出2009-2011我國可考慮參與之技術議題。 3. 平時交流:為利經驗傳承,特摘要近二年之國際交流議題及主要對象之聯繫內容。 (二) 國際參與-亞太區域 1. 亞太地區電子廢棄物合作計畫之最新動向:該計畫期程延長至2009年,除原本的十個參與國家外,新納入二個巴塞爾公約區域中心及一個印度非政府組織。 2. 完成參與亞太區域五個會議,含三篇論文發表:(1)第四屆、第五屆亞洲太平洋島嶼固體廢棄物專家會議,分別於7月16~18日及11月12~13日舉辦,由專家小組成員馬小康教授參加;(2)第三屆固體廢棄物管理與技術研討會於11月5~7日舉辦,由專家小組成員高思懷教授參加;(3)第五屆NIES電子廢棄物研討會於11月17~18日舉辦,第十九屆日本廢棄物學會研究發表會於11月19~21日舉辦,由本會林姿君助理研究員參加。 3. 完成日本國立環境研究所(NIES)研究報告有關廢電機電子物品物質流部分之專題研析:完成前述日本報告之研讀與摘譯,並提出國內建議作法。 (三) 國際參與-OECD-SMM相關之研究 1. 完成第二屆OECD永續物質管理研討會(2008.04)之參與,並於該會議中以簡報及論文方式分享我國經驗。 2. 彙整分析國內與SMM相關之政策、法令、研究計畫成果、案例分析及OECD永續物質管理研討會參與資訊,提出我國政府SMM政策原則與我國SMM推動計畫表。 (四) 國內運作-廢棄物越境轉移事務執行 1. 巴塞爾公約專家小組會議:完成辦理三次巴塞爾公約專家小組會議,計有10個報告案及一個討論案,如廢棄物管制清單討論及各項出國報告。 2. 協助廢棄物輸出入管理相關事宜: (1) 協助對外諮詢事項:完成四國有關財務保證之法源、計算及金額提供方式之初步諮詢;與國際環保團體巴塞爾行動網路(BAN)聯繫電子廢棄物越境轉移事宜。 (2) 協助對內執行事項:完成查詢中國「限制進口廢物審批表」、蒐集境外供貨企業名單、更新中國固體廢棄物管理法規及我國主辦2009-2010廢棄物相關國際會議之初步規劃。 (五) 國內運作-法規調整建議 1. 提出廢棄物輸入輸出過境轉口管理辦法修改建議: (1) 摘要現行法規及二法合一有關長期廢棄物輸出入草案之規劃。 (2) 有關「廢棄物輸入輸出過境轉口管理辦法」草案修正的部份:經本計畫協助檢討完成修正草案後,環保署已於今年7月7日召開公聽會,並於9月5日發布公告。並對管理辦法修正內容分成大幅修改、因應執行需求及其他三個部份說明。 (3) 協助「廢棄物輸入輸出許可審查作業要點草案」之研擬:架構略做調整,修訂內容與現況差異不大。 2. 研擬廢棄物越境轉移管制清單草案: (1) 配合廢棄物清理法第38條之授權,完成現行管制清單說明。 (2) 完成禁止輸入廢棄物種類公告草案,並彙整「有害事業廢棄物國內實際處理量及許可處理量」及「國內無處理能力之有害事業廢棄物種類」,以利後續執行。 3. 國外法規資料蒐集:完成日本、中國、菲律賓之廢棄物越境轉移法規及管制清單介紹。 (六) 國內運作-資訊蒐集宣導 1. 蒐集摘譯巴塞爾公約國際新聞、報導及論文:已蒐集摘譯巴塞爾公約、電子廢棄物及廢棄物越境轉移相關新聞120則(含論文14則)。 2. 維護更新專屬中英文資訊網站:完成更新網站23次。 3. 會議辦理:(1)於2008年5月28日完成辦理一場次「97年度廢棄物輸出入管理報關行說明會」;(2)於2008年9月18-19日完成辦理一場次「97年度廢棄物越境轉移管理業務檢討會」。

Management of Transboundary Movement of Solid Waste: under the framework of international practice and domestic waste management (2008)

英文摘要 The major achievement of this project can be classified into two parts: the international participation and the domestic implementation which conclude six aspects as follows. 1. International Participation at the global level (1) Basel Convention Partnership Programme: (A) The Mobile Phone Partnership Initiative(MPPI), a six-year project of the Basel Convention, was formally closed at the Ninth Conference of the Parties(COP 9)in 2008. The achievements of MPPI and the contribution from us (in name of Institute of Environment and Resources, IER) to MPPI has summarized in this report. (B) For the Partnership for Action on Computing Equipment(PACE), established under the COP 9 of the Basel Convention after eight months of preparation, the analysis for three key issues of the preparatory work, a summary of the PACE teleconferences and the recommended ways of future participation have been completed by our project. (2) Participation in the COP 9 of the Basel Convention in June, 2008: Three experts from Taiwan attended this conference. We suggested technical issues for more active participation during 2009-2011. (3) International Networking: The main communication minutes and information about the contact windows have been summarized based on our long-term involvement. 2. International Participation at regional level (Asia-Pacific) (1) The latest development of the Asia Pacific Regional E-waste Project led by Secretary of the Basel Convention and Japan’s Government has been extended to 2009. Also there is new participation from two Basel Convention Regional Centers(BCRC)and one Indian Non-Governmental Organization(NGO). (2) We participated in five international conferences presenting three publications. The international conferences in Asia-Pacific region that four experts from Taiwan attended are the 4th and the 5th Expert Meeting on Solid Waste Management in Asian and Pacific Islands, the 3rd International Conference on Waste Management and Technology, the 5th NIES E-Waste Workshop and the JSWME 19th Annual Conference.(where JSWME: Japan Society of Waste Management Experts) (3) The Case Study regarding material flow of E-Waste of National Institute for Environmental Studies (NIES) in Japan has been summarized. Suggestions to Taiwan have also been made. 3. International Participation in Sustainable Material Management of the Organization for Economic Cooperation and Development (OECD-SMM) (1) Conference Participation: Two experts on behalf of Chinese Taipei attended the 2nd OECD Workshop on SMM sharing Taiwan’s experiences through oral presentation and papers. (2) Domestic SMM Policy and Plan Drafting: We drafted the domestic SMM Policy and Plan based on the compilation of the SMM related policies, regulations, researches and case studies. 4. Domestic Implementation of Transboundary movement(TBM)of Waste (1) We held three meetings with Basel Convention Expert Committee in 2008. In which, issues including the domestic TBM lists and reports of six international conferences regarding the Basel Convention were deliberated. (2) Our project has provided assistances to the Environmental Protection Administration in the implementation details of financial guarantees of four developed countries. We also clarified the concrete TBM case of E-waste for Basel Action Network(BAN)and updated the Chinese regulatory information as well as made suggestions for holding the international conferences in Taiwan for 2009-2010. 5. Providing legal advises on the regulations regarding TBM of waste (1) Assistance on the revision of the “Management Regulations for the Import, Export, Transit and Transshipment of Waste” has been provided. First of all, we collected and summarized current regulations including long-term planning, then helped EPA holding the public hearing on July 7, 2008 and the official announcement of the revised regulation on September 5, 2008. We also accomplished the regulation draft for the “Examination of the Import and Export Permit of the TBM of Waste.” (2) Based on the current list under article 38 in the Waste Disposal Act, we accomplished the list draft of wastes prohibited for importing. We also summarized the domestic treatment capacity of waste for future considerations. (3) The TBM regulations in Japan, China and Philippines have been collected and complied as reference materials for Taiwan EPA. 6. Collecting and promoting Basel Convention related information (1) We have completed evaluation on 120 news, articles, reports and papers regarding to the Basel Convention, E-waste and TBM of waste. (2) Both Chinese and English Basel Convention information websites were updated for 23 times (http://wm.epa.gov.tw/web/index.htm). (3) Two workshops respectively for customs brokers and domestic officials were held in 2008.
